The National Employment Standards (NES) applies to all employees under the national workplace relations framework. All non-casual employees are guaranteed a minimum of four weeks of paid leave annually. Shift workers might qualify for extra leave according to the relevant modern award, agreement, or the Fair Work Act 2009.

Common FAQs when it comes to leave

  1. What is the Difference Between Personal, Carer’s, and Sick Leave? There is no difference between personal leave, carer’s leave, and sick leave. These terms all refer to the same type of leave entitlement under the NES. What was previously known as sick leave is now called ‘personal/carer’s leave’.
  2. How does annual leave accumulate? It starts from the day the employee starts work.
  3. What information should I include in my letter? Begin with addressing the type of leave, the specific dates planned for your absence, a brief reason, and supporting documentation. This will allow your manager to understand your needs and best prepare for your absence.
  4. What should I do if my leave request is declined? Speak to HR or ask for a meeting with your manager/supervisor to ask for further clarification. You may need to adjust handover docs, there may be other reasons.

It is important to communicate with your manager before sending the leave request so that they are prepared and can advise you on how to best approach the situation.
